Company in Belarus (the Developer) and company in Belgium (x) (the Customer) have professional software development and conveyance agreement. In accordance with hereunder in case Parties cannot resolve a dispute it should be determined to be the court at Developer's location.
According to the agreement, Developer sent Customer act of conveyance of work done and they weren’t signed by Customer's side until now. Still, based on the clauses of the mentioned agreement these acts are considered to be signed. But Customer gave an answer that he disagrees that the work was done and that he did not recognize the legal system, courts etc in Belarus. On the basis of the above What court will Developer have to choose for resolve to dispute and how the Belgium court system to recognize and enforce awards made in the territory of another contracting State (in this case the State of Belarus)?

Hi,

The forum selection clause is part of the agreement. The customer (a professional - not a consumer, I assume) has to respect this.

Be aware that this does not mean that the law of Belarus has to be used - it merely states that the forum (= the court) has to be in Belarus and proceedings take place there.

Belarus is not part of the EU, so judicial decisions will have to be legalized before they can take action in the EU. It is true that the reputation of Belarus justice system is not that great. There is no international treaty between the EU and Belarus as far as I know on this matter, so the Belgian procedure for legalisation will apply.
